Temporary Skill Shortage visa (subclass 482) ("TSS")

 

3 streams

  1. Short term: maximum of 2 years or 4 years if an international trade obligation (ITO) applies

  2. Medium term: up to 4 years with eligibility to apply for permanent residence after three years

  3. Labour agreement: special agreement with the Commonwealth. Must demonstrate Australian labour and first 2 streams not available.

 

If under the third stream, there are 5 types of labour agreements: 

  • Company specific labour agreements

  • Designated area migration agreements ("DAMA")

  • Project agreements

  • Global Talent Scheme (GTS) agreements

  • Industry labour agreements

What can you do with this visa

  • Can work in Australia (for your sponsor only);

  • Bring family to Australia;

  • Can travel overseas

 

What are the stages involved

  1. Find a sponsor (labour agreement stream is different)

  2. Get the sponsor to nominate you

  3. Apply for the visa

 

How to apply for the visa

  1. Apply online. In very limited circumstances, application may be done by alternative lodgement.

  2. Ensure that your sponsor is able to sponsor you

  3. Do a Skills Assessment (only if it applies to your job)

  4. Meet the requirements of the 482 visa, at the time the decision is being considered

    1. Substantial compliance of existing visa (if in Australia)

    2. Approved sponsor nomination

    3. Genuine or real intention to work for your sponsor

    4. Health insurance

    5. Be in good health

    6. Meet the Public Interest Criteria ("PICs"), a few examples include:

      1. Must not owe money to the Australian Government

      2. Must be of good character

      3. Must hold a valid passport

  5. Must not have had an Australian visa cancelled or refused (exceptions apply)

 

 

Additional requirements for short-term visa primary applicants

  1. At least 2 years work experience

  2. Meet the Sufficient English requirement by doing an approved English Test unless you are given an exemption

    1. an International English Language Testing System (IELTS)

    2. an Occupational English Test (OET)

    3. a Test of English as a Foreign Language internet-based test (TOEFL iBT)

    4. a Pearson Test of English (PTE)

    5. a Cambridge English Advanced (CAE)

 

Additional requirements for medium-term visa primary applicants

  1. At least 2 years work experience

  2. Meet the Sufficient English (higher than short-term) requirement by doing an approved English Test unless you are given an exemption

    1. an International English Language Testing System (IELTS)

    2. an Occupational English Test (OET)

    3. a Test of English as a Foreign Language internet-based test (TOEFL iBT)

    4. a Pearson Test of English (PTE)

    5. a Cambridge English Advanced (CAE)

 

Additional requirements for labour agreement visa primary applicants

  1. The job must be specified in the labour agreement

  2. At least 2 years work experience (unless exemption is provided)

  3. Meet the Sufficient English requirement by doing an approved English Test unless you are given an exemption

    1. an International English Language Testing System (IELTS)

    2. an Occupational English Test (OET)

    3. a Test of English as a Foreign Language internet-based test (TOEFL iBT)

    4. a Pearson Test of English (PTE)

    5. a Cambridge English Advanced (CAE)

 

Requirements for secondary visa applicants

  1. Substantial compliance of existing visa (if in Australia)

  2. Must be family member of primary applicant for 482 visa

  3. Must have health insurance

  4. Meet the Public Interest Criteria ("PICs") same as the primary applicant

  5. Must not have had an Australia visa cancelled or refused (exceptions apply)
